Remortgaging when your partner has been bankrupt

A partner’s bankruptcy is recorded on their own credit file, but joint finances can still bring you into the picture.

In short

  • A partner’s bankruptcy is recorded on their file, not automatically on yours.
  • A joint mortgage or joint account creates a financial association a lender may consider.
  • If you own the home jointly, only your partner’s share passes to their trustee.
  • A notice of disassociation can be requested once you no longer share any finances.

No obligation. Approximate figures are fine.

Your home may be repossessed if you do not keep up repayments on your mortgage.

A partner’s bankruptcy is recorded on their own credit file, not yours, and it does not appear as an entry on your report simply because you live together or are married. However, if you hold a joint mortgage, joint bank account or other joint credit, the credit reference agencies link your files as a financial association, and a lender assessing you may look at your partner’s history too.

This page looks at what a partner’s bankruptcy means for a joint remortgage, what happens to their share of the home, and how financial associations work. If the bankruptcy was your own, see our main remortgage after bankruptcy page instead.

Does my partner’s bankruptcy affect my own credit file?

No, not directly. Your partner’s bankruptcy is their own record, and it will not appear as an entry on your credit report just because you are married, in a civil partnership or living together. What can happen instead is a financial association: a link the credit reference agencies create between your files because you share a financial product, most commonly a joint mortgage, joint bank account or joint loan.

A lender assessing your application may look at anyone you are financially associated with, which is why a partner’s bankruptcy can still come up in an affordability or credit assessment even though it is not on your own file.

What happened to your home if you own it jointly?

When a bankruptcy order is made against your partner, only their beneficial interest in the property passes to the trustee. Your own share is unaffected, but the trustee’s interest in your partner’s share still needs to be resolved before a joint remortgage can usually proceed, in the same way it would for a sole bankrupt owner.

Check the title register

A trustee’s interest, or a restriction relating to it, is often registered against the property title. Ask a solicitor to check this before you plan a remortgage.

Can you remortgage jointly while your partner is bankrupt or recently discharged?

What tends to apply to a joint remortgage
Your partner’s situationWhat it can mean for a joint application
Still undischargedVery rarely possible while their interest in the home is unresolved and legal restrictions apply to them.
Recently dischargedSimilar to a sole applicant recently discharged: a small number of specialist lenders may consider it, often needing significant equity.
Discharged some years ago, clean record sinceMore lenders may consider a joint application, assessing both of you.
You want to remove your partner from the mortgageA transfer of equity removes them as borrower and owner, but you alone must then pass affordability for the whole mortgage.

General information only. Every lender assesses joint applications on its own criteria.

What if you no longer share finances with your partner?

After a separation, or if you have simply closed all joint accounts, you can ask each credit reference agency for a notice of disassociation. This removes the financial link so a lender assessing you alone should no longer see your former partner’s history, including their bankruptcy.

If you are separating and need to sort out a jointly owned home, our page on remortgaging after divorce or separation with bad credit covers transfers of equity in more detail. Removing a borrower always needs the lender’s agreement.

What if your partner’s bankruptcy followed a business failure?

Bankruptcy for a homeowner sometimes follows a business difficulty rather than personal debt. If that is your partner’s situation, a lender assessing a joint application may ask about their current work as well as yours. Our page on self-employed remortgages with bad credit explains what is usually asked for.

If your partner’s bankruptcy is more recent, our main page on remortgaging after bankruptcy sets out the general timeline, including what discharge changes and what tends to happen at different stages as the years pass.

What matters when your partner has been bankrupt

What matters when your partner has been bankrupt
FactorWhy it matters
Whether you have any joint financesA financial association only exists where you share a joint account, loan or mortgage.
Your partner’s discharge statusWhether they are undischarged, recently discharged or years past it changes what a joint lender may consider.
The trustee’s interest in their share of the homeThis normally needs resolving before a joint remortgage can proceed, if you own the property jointly.
Whether you are applying jointly or aloneRemoving your partner from the mortgage means you alone must pass affordability for the full amount.
Your own credit historyAssessed independently, though it may be viewed alongside your partner’s if you remain financially linked.
Mortgage payment historyA joint payment record kept up to date throughout is looked at closely.
Loan to value and equityMore equity generally widens the choice of lenders for a joint application.
Income and affordabilityAssessed for both applicants on a joint mortgage, or for you alone if your partner is being removed.

These are general points, not lender rules. Each lender sets and changes its own criteria.

Information an adviser may ask for

You don’t need all of this to make an enquiry. It helps to know where to find it, because an adviser is likely to ask about most of it.

  • Whether you hold any joint accounts, loans or mortgage with your partner
  • Your partner’s bankruptcy order date and discharge date
  • Written confirmation from the trustee about your partner’s interest in the home
  • Credit reports for both of you, from Experian, Equifax and TransUnion
  • Your current mortgage balance and payment history
  • Proof of income for both applicants, or for you alone if removing a borrower

Frequently asked questions

Will my partner’s bankruptcy show up when I apply for a mortgage on my own?

Not directly, but if you have any joint accounts or a joint mortgage together, the agencies link your files as a financial association, and a lender may look at your partner’s history as part of assessing you.

Can I remove the financial link to my partner?

Yes, once you no longer share any joint finances, you can ask each credit reference agency for a notice of disassociation, which removes the link between your files.

What happens to jointly owned property if my partner goes bankrupt?

Only your partner’s beneficial share passes to their trustee. Your own share is unaffected, but the trustee’s interest in their share usually needs resolving before you can remortgage jointly.

Can I take my partner off the mortgage if they were bankrupt?

This is done through a transfer of equity, which needs the lender’s agreement. You would then need to pass affordability for the whole mortgage on your own income.

Does a joint mortgage mean we are both bound by the 6-year credit file rule?

The bankruptcy entry itself sits on your partner’s file for 6 years from the order date. It is the financial association, not the bankruptcy entry, that links to your file, and that can be removed once you no longer share finances.
